Terms & Our Agreement

These Terms of Use, together with any and all other documents referred to herein, set out the terms of use under which you may use these Services: Brilliance 1:1 Mentorship with Ali Mortimer. Please read these Terms of Use carefully and ensure that you understand them. Your agreement to comply with and be bound by these Terms of Use is deemed to occur upon your first payment. If you do not agree to comply with and be bound by these Terms of Use, Ali Mortimer will not be able to provide this service - please contact Ali Mortime on ali@alimortimer.com. 

1. client agreement

This Client Agreement (the “Agreement”), will be dated from the date of payment received and is for the arrangement of life, love, health, work mentorship between the “Company” or “Coach”, Ali Mortimer of ALIMORTIMER and the name of the person making the payment - unless specified otherwise (hereafter known as “Client”, and collectively, the “Parties”). 

WHEREAS, Company provides coaching & mentoring (“Services”); and WHEREAS, Client wishes to retain Company and accepts the terms and conditions set forth herein to provide such Services.

Please read the following simple terms and conditions, and sign at the end of this document to confirm that you understand and agree.

2. OVERVIEW

It is The Coach’s intention to help facilitate the growth, development, and achievement of Your work, business, life, purpose, fulfilment & wellbeing goals. The Coach will provide information, support, accountability, perspective, and resources during our work together. The Coach will ask questions and guide discussions designed to prompt or clarify Your goals and provide accountability for achieving self-determined life goals (the “Services”). 

The Coach will not run or be responsible for your health, happiness, relationships, life, career or work for you, or the decisions & choices you make for yourself. The Coach-Client relationship is driven by you – The Client’s intentions, values, initiative, and vision. Ultimately it is the Client’s commitment to the fulfilment of that is in their hands, and they are solely responsible for choices and actions taken pursuant to Services; therefore, the outcomes are up to The Client. The Coach is there to support you, guide you, and provide accountability to the Client as they work towards their Goals.

3. ali mortimer coaching services: Brilliance 1:1 Mentorship

The Services will specifically consist of

  • Private sessions:

    • Weekly sessions via zoom for 60 minutes with Ali Mortimer to discuss any of the following and not limited to: business, work, career, purpose, life, relationships, holistic health, your desires and vision, fears & worries, challenges & triumphs, your thoughts & feelings, your energetic frequency & personal harmony, your personal ‘power’ & what fuels your energy & vitality.

    • All sessions are held via zoom - either with your camera on or off, whichever you feel the most comfortable doing.

  • ‘In your pocket’ support:

    • Support in between live sessions, for those moments when you need a guiding hand, a life line in a moment doubt or low self-esteem, a lift, a ‘pep talk’ & where Ali can share guidance, mentorship & support in the moment, rather than having to wait for a private session.

    • A space for you to speak your truth & mind freely, to document your thoughts, to brainstorm out loud, to celebrate & commiserate.

    • Support is using the app ‘Voxer’ or ‘Telegram’ (an App like whatsapp to send voice and text messages but means we can keep business and private communication separate). A separate link will follow via email.

    • You are free to communicate via this channel 24/7 and you can use this support as much or as little as you wish.

    • Ali will be checking in to your channel at least twice a day during her working days (Monday to Friday between 8.30am-6.30pm). Any exceptions will be due to family emergency or scheduled event and always communicated.

  • Additional materials:

    • As required, Ali will provide additional materials to support any conversations & guidance. This may include any of but not limited to the following:

      • Your Human Design –  which we can refer to throughout your package to support you energetically, emotionally, mentally, spiritually and to support your holistic health & wellbeing as well as decision making.

      • As required, access to a library of trainings recorded by Ali over her years of mentorship & coaching.

      • Podcasts, books, Ted Talks / You-tube Trainings, etc

4. remit

You acknowledge that Ali Mortimer is not a counsellor, therapist, doctor, lawyer, nor a legal, financial or tax expert, and You will agree to consult such experts separately to obtain proper legal and tax guidance, psychological or medical support

5. communications & code of conduct

For coaching sessions:

All coaching sessions take place via zoom/phone for up to 60 minutes.  We will schedule all your sessions in advance (typically on the same day & time each for ease of both parties).  This will be the same zoom link for each session so please store this somewhere safe for easy access. 

Recordings of our sessions will be sent to you post session for your future reference and to be downloaded within one week, noting that Ali clears her cloud recordings after one week.

If over the phone, it is the client’s responsibility to call Ali Mortimer at the agreed times, noting that these sessions will not be recorded.

It is Ali’s desire that you maximise your investment and mentorship experience with her, and she highly values your time, therefore she will always be ready to start on schedule (in the event of any unforeseen delays she will contact you ASAP by text or Email and any lost time on her part will be made up).  

Please do the same for Ali.  Ali will wait for a maximum of 5 minutes after your scheduled start time, unless she has heard from you via text / email that you will be later.  In which case your session will still finish on time; she is unable to rearrange any late attendance or missed sessions that are not rescheduled with 48 hours notice (other than exceptional circumstances in which she will rearrange at her discretion). 

You have up to 1 session included every week, while these are available to you but not mandatory and is at your own discretion to show up for these.  Ali would be grateful if you could advise us if you will not be taking your session that week and we may be able to reschedule with 48 hour’s notice subject to our availability.

For support in between sessions:

You are free to communicate via Voxer/Telegram 24/7, weekdays & weekends and you can use this channel as much or as little as you wish.  Ali will be checking in to Voxer at least twice a day during her working days (Monday to Friday between 9.30am-6.30pm). Any exceptions will be due to family emergency or scheduled event and always communicated.

Emergency support outside sessions: Any questions relating to your sessions please email ali@alimortimer.com 

6. TERM

The Parties are committed to working together for 6 months from the date of payment received will and continue for the full term unless otherwise extended, by agreement. Please note any extensions may be subject to price changes.

  

7. holidays and breaks

Contracts are for a continued duration of 6 months and are unable to be ‘paused’ or ‘put on hold’ to be resumed at a later date.  Ali is able to accommodate holidays during our contract.

 

Your Holiday: You may move up to one session over a 3-month period to be rescheduled and taken on another date to be scheduled before the end of our term.   

 

Ali’s Holiday: To support her holistic wellbeing and embody the practices she teaches, Ali will take up to 5 weeks of holiday per year. During this time, live 1:1 Zoom sessions will not take place and will not automatically be rescheduled.

However, “In your pocket” support (via voice note, message, or email depending on your package) will continue.
Within a 6-month container, this may include up to 2 weeks of holiday time.

If exceptional circumstances arise and she feels additional support time is needed, Ali may offer to extend or deepen existing sessions (at no extra cost).

Thank you for honouring this rhythm as part of our energetic agreement.

Cancellation or rescheduling of sessions: Any sessions that cannot be attended and are advised in advance (with 48 hours notice - except for exceptional circumstances including illness) will be rearranged at a suitable time for both parties.  Any sessions not attended without notice, due to late attendance or missed will not be rearranged other than in exceptional circumstances and at our discretion.

8. payment

The full cost of your agreement with Ali Mortimer – for Brilliance 1:1 Mentorship for 6 months is £10,000 which can be paid in full, in advance, in two instalments of £5000 over the first two months or in monthly instalments in advance of £1700.  This can either be paid through Stripe or by BACS (on request).

 

On receipt of payment, to secure your mentorship, in advance of private sessions starting, Ali will provide the following to provide a foundation for mentorship:

  • Your Private Voxer / Telegram channel to initiate conversations.

  • Access to the Love Club Library portal which contains all recording trainings, masterclasses & courses.​​

9. termination

Paying monthly or in full: You will be paying for services for a minimum of 3 months. This does not allow for cancellation of services at any point during the agreement and due to the nature of our services all payments are non-refundable.

 

Failure to ensure available funds at the time that payment is collected will result in services being stopped until payment in settled. Any outstanding amounts may be sent to collections if Payment is not received or a payment plan is not reached between the Parties after thirty (30) days from due date. 

 

No payments due under this Agreement will be adjusted for exchange rate fluctuations. 

10. confidentiality

The Client understands that the nature and existence of this Agreement is considered “Confidential Information,” as well as the methods and direct questioning used by Us during Calls, all materials provided by Us and used pursuant to the Services are Confidential and proprietary in nature and other than for Client’s personal use, there is no grant from Us to You of any future right to use these materials or processes in any way without express training, written permission, and licensing from Us. 

In addition, all other information shared by other participants during Sessions shall be considered Confidential, and not shared with others without express permission. Breach of the duty of confidentiality shall be considered a material breach, and Ali Mortimer may seek full damages, accordingly. 

11. no resale & no transfer of Intellectual property

The Client agrees not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of the Service (including Session materials). 

The ALI MORTIMER brand name and all other copyrighted, trademarked, and original or proprietary materials provided to You from Ali shall be “ALIMORTIMER IP”. The ALIMORTIMER IP is provided for Your individual use only and shall be considered a single-user license. You are not authorized to share, copy, distribute, or otherwise disseminate any materials received from Ali Mortimer electronically or otherwise without Our express prior written consent. No license to sell or distribute ALIMORTIMER IP or materials is granted or implied. 

12. client responsibility & no guarantee

Client accepts and agrees that Client is 100% responsible for her progress and results from the Programme.  Company will help and guide Client; however, participation is the one vital element to the Programmes success that relies solely on Client.

 

Company makes no representations, warranties or guarantees verbally or in writing regarding the Client’s performance.  Client understand that because of the nature of the Programme and extend, the results experienced by clients may significantly vary.  

 

13. dispute resolution

In the event of any dispute arising from or relating to this Agreement (a “Dispute”), the affected Party shall promptly notify the other Party (the “Notice”) and the Parties shall attempt in good faith to resolve the Dispute. 

 

The following procedure shall be used to resolve a Dispute: 

First, the Parties shall attempt to resolve the Dispute over the phone or via conference using video technology such as Zoom within ten (10) days of the Notice. 

Next, the Parties shall attempt to settle the Dispute by mediation administered by legal party.

If the Parties are unable to resolve the Dispute through mediation, then the Parties will submit to binding arbitration. In the event that a Dispute results in mediation, arbitration, or litigation of any kind, the extent of each Party’s damages will be limited to the amount due or paid under this Agreement. The prevailing party in any such mediation, arbitration, or litigation shall recover any solicitor’s fees arising from or out the Dispute. 

Client hereby assents to have read and completely understand this Agreement, intends to be legally bound by the terms and conditions stated herein. Therefore, the Parties hereby agree to abide by them as of the date last written below, or the date of the Call, whichever occurs first.

14. Changes to these Terms of Use

1We may alter these Terms of Use at any time. Any such changes will become binding on you upon your first use of Our Site after the changes have been implemented. You are therefore advised to check this page from time to time.

In the event of any conflict between the current version of these Terms of Use and any previous version(s), the provisions current and in effect shall prevail unless it is expressly stated otherwise.

15. data protection

Any and all personal information that We may collect will be collected, used and held in accordance with the provisions of the Data Protection Act 1998 and your rights and Our obligations under that Act.

We may use your personal information to:

  • Provide and administer your Account;

  • Reply to any communications you send to Us;

  • Send you important notices

We will not pass on your personal information to any third parties, unless mutually agreed.

17. Law and Jurisdiction

These Terms and Conditions, and the relationship between you and Us (whether contractual or otherwise) shall be governed by, and construed in accordance with the law of England & Wales.

If you are a consumer, you will benefit from any mandatory provisions of the law in your country of residence. Nothing in Sub-Clause above takes away or reduces your rights as a consumer to rely on those provisions.

If you are a consumer, any dispute, controversy, proceedings or claim between you and Us relating to these Terms and Conditions, or the relationship between you and Us (whether contractual or otherwise) shall be subject to the jurisdiction of the courts of England, Wales, Scotland, or Northern Ireland, as determined by your residency.

If you are a business, any disputes concerning these Terms and Conditions, the relationship between you and Us, or any matters arising therefrom or associated therewith (whether contractual or otherwise) shall be subject to the exclusive jurisdiction of the courts of England & Wales.

Your agreement to comply with and be bound by these Terms of Use is deemed to occur upon your first payment. If you do not agree to comply with and be bound by these Terms of Use, Ali Mortimer will not be able to provide this service - please contact Ali Mortimer on ali@alimortimer.com.
